Kaphale Appeals Constitutional Court ruling to Supreme Court of Appeal.

Beleaguered country’s Attorney General Kalekeni Kaphale has appealed the Constitutional Court ruling that the presidential elections results case be continued.
President Peter Mutharika’s lawyers petitioned the court to dismiss the case in which Dr. Lazarus Chakwera of Malawi Congress Party and United Transformation Movement Leader Dr. Saulos Chilima are challenging presidential election results.
The two leaders Chilima and Chakwera are disputing the results, saying the 21st May elections were marred with several irregularities as some Malawi Electoral Commission officials used Tipp-Ex to alter result sheets.
The Constitutional Court presided over by 5 judges has ruled that the case be continued and full trial will commence on 26th June at 9 o’clock in the morning.
Meanwhile, Kaphale representing Democratic Progressive Party has filed an appeal to Supreme Court of Appeal to continue challenging that the case be declared invalid.
However, some law experts have argued that any constitutional court ruling cannot be appealed as it is the highest court above all.
MEC Chairperson Dr. Jane Ansah on 27 May, declared DPP candidate Mutharika as the winner in the presidential race saying the elections were credible, free and fair.
Civil Society Organizations under the banner Human Rights Defenders Coalition (HRDC) held demonstrations on Thursday demanding the resignation of Dr Ansah saying she failed to address issues surrounding election.
