A 34-year-old man in Dowa, Gerald Banda, has been convicted and sentenced to 14 years imprisonment with hard labour for assaulting his wife.
The Mponela First Grade Magistrate’s Court imposed this deterrent sentence on April 29, 2021 to act as a lesson to would be offenders. Banda was being accused of scalding his 31-year-old wife, Hanna Kafantenganji of Nakhalu Village, T/A Kayembe in Dowa with hot water was arrested on 14 February 2021.
Appearing before First Grade Magistrate Anthony Chimphonda Banda, Gerald denied the charge which prompted the prosecution team, led by Assistant Superintendent Gladys Jentala, to parade four witnesses. She proved before court that Hanna was admitted to Madisi Mission Hospital after she had survived from burn wounds following the assault.
Jentala further said that prior to the incident, the convict had arrived home late in the evening and found his three children still not around. He started accusing his wife of letting the children go out; suspecting her of having a sexual affair. According to the victim, disagreements started which ended into fight and in the course the man scalded the wife with hot water.
A medical report indicated that a wider part of her body was severely injured. The First Grade Magistrate Anthony Banda bemoaned over increased reports of gender based violence in Dowa. He therefore sentenced him to 14 years imprisonment with hard labour for acts intended to cause grievous harm contrary to Section 235 (A) in order to act as a lesson to those would be offenders.
Coincidentally, while the sentence was being announced the same court was registering a similar case where a 21-year-old woman, Tiwonge Jerald who comes from Msampha Village, T/A Mponela in Dowa is also being accused of scalding her neighbour with hot water.
